Three released from jail in New Mexico compound case
Judge Emilio Chavez ordered charges to be dropped against Lucas Morton, his wife Subhannah Wahhaj and her sister Hujrah Wahhaj because prosecutors had failed to follow a procedural rule after they were charged and jailed. "They're out now," said Megan Mitsunaga, a defense attorney for Subhannah Wahhaj. The three still face a criminal trespassing case in magistrates court in Taos County for building their makeshift settlement on a plot of land near Amalia, New Mexico, that did not belong to them, Mitsunaga said.

'Sadist' used high-profile tragedies to troll grieving families on Facebook, court hears
A "sick sadist" internet troll used high-profile tragedies to target grieving families, a court has heard. Paul Hind, 38, posted offensive material on Facebook about four dead young people. He called Olivia Burt, a 20-year-old Durham University student who died from head injuries after an incident outside the city's Missoula nightclub in February, a "sex worker" and "prostitute" on the social media site. South East Northumberland Magistrates' Court heard on Thursday that the defendant, of Westacres in Wark, also doctored an image of the dead woman and posted pictures of children who were "clearly terminally ill" on her Facebook page on April 20. Speaking after Hind had admitted four separate offences of conveying false information which was indecent or grossly offensive, Ms Burt's father, Nigel Burt, from Hampshire, said his actions were a "desecration" of his daughter's memory. Describing how the postings had made him and Ms Burt's mother, Paula Burt, feel "physically sick", he said: "The person who carried out this trolling can only be described as a sick sadist who knows that they are adding to our anguish and gets enjoyment out of this. "Even though the Facebook posts have now gone, we keep expecting them to reappear on some other social media platform. "This is causing us continuing anxiety and distress." Durham undergraduate Olivia Burt who was killed in a crush while queueing to gain entry to the Missoula nightclub Credit: Social media Mr Burt added: "We would also like to say that our dealings with Facebook have compounded our misery." He said the social media giants only tackle individual posts and not "overall trolling", describing this method as "hopeless". As well as Ms Burt, Hind also targeted a tribute page for Hannah Witheridge, a 23-year-old who was killed on the Thai island of Koh Tao in 2014. The other counts related to the deaths of Joe Tilley, 24, who was found dead at the bottom of a waterfall in Colombia in May, and 19-year-old Duncan Sim, whose remains were found at West Sands in St Andrews earlier this year. District Judge Kate Meek sent the case to Newcastle Crown Court for sentence on September 27, and praised the Burt family for sitting in on the proceedings. Judge Meek also passed on her "deepest condolences" for the loss of their daughter and said that the defendant had only added to the "already unimaginable" pain that they were suffering. Nigel and Paula Burt Credit: Owen Humphreys/PA Wire Speaking outside court after the hearing, Hind said he was "deeply sorry" for his actions and that he had done them "for attention". Describing how he was suffering from mental health issues and was "highly intoxicated" at the time of the offences, he said: "All I can say to the families for the actions I have committed is sorry, that is all I can say - sorry. "I don't expect them to accept any apology from me whatsoever for what I have done." When asked whether his actions could be seen as worthy of a jail sentence, he said: "From my point of view, personally, and for what I did, I would say yes. "I do deserve a punishment, and I don't just deserve a punishment of being banned from social media, trying to apologise to the parents and forgetting about the whole thing. "I have to be punished accordingly for causing people the anxiety and the stress I have caused them, there's no question about that."

Republican Florida candidate says vote for black opponent would 'monkey this up'
Accusations of racism flared up on Wednesday in the Florida governor's race after the Republican candidate told voters they would "monkey this up" if they chose a liberal African-American Democrat backed by Senator Bernie Sanders. The upset victory by Democrat Andrew Gillum, 39, in the Florida gubernatorial primary was the most notable of a slate of party primaries held on Tuesday to decide candidates for the midterm election. Gillum's opponent in November will be Representative Ron DeSantis, an enthusiastic backer of President Donald Trump who surged in the polls in Florida, America's third-largest state, after earning the endorsement of the president.

Trump administration backs Asian-American students in race case against Harvard University
The Trump administration has sided with Asian-American students in a lawsuit alleging Harvard University has failed to demonstrate it does not discriminate on the basis of race. Students for Fair Admissions (SFFA) filed a lawsuit against Harvard in 2014 alleging the university discriminates against Asian-American applicants by setting caps on the number of Asian-American students. The filing marks another instance of the administration’s efforts to encourage more race-neutral admission practices.

Vatican whistle-blower renews attacks on Pope Francis over disgraced cardinal as crisis in Catholic Church deepens
A Vatican whistle-blower who has accused Pope Francis of having covered up sexually abusive behaviour by an American cardinal stepped up his attack on Wednesday, speaking from a secret location. Archbishop Carlo Mario Vigano, a former Vatican ambassador to the US, has plunged the Catholic Church into crisis with allegations that the pope failed to act against Theodore McCarrick, a US cardinal, who was accused of sexually abusing young priests over decades. Cardinal McCarrick, the former archbishop of Washington, resigned in disgrace last month, becoming the first cardinal to step down since 1927. Archbishop Vigano, 77, released an 11-page document detailing the allegations at the weekend and called on Francis to resign. He then went underground amid reports that he feared for his safety. After days of silence he gave an interview, from an undisclosed location, to an Italian journalist, renewing his criticism of Francis’ papacy. Cardinal Theodore McCarrick resigned in disgrace in July Credit: Max Rossi/Reuters “I spoke out because corruption has now reached the highest levels of the Church hierarchy,” he said, claiming he had received broad support for his actions. “I have had messages from priests and the faithful who have thanked me because my testimony was for them a glimmer of hope for the Church.” He denied that he was pursuing a “vendetta” against Pope Francis and cardinals close to him. Vatican analysts say the attack appears to be part of a concerted effort by conservatives to oust Pope Francis, who they dislike for his relatively liberal views on issues such as acceptance of homosexuals, allowing divorcees to take Communion and his push for a more inclusive Church. “It really seems like an obvious move by conservatives to de-legitimise Francis," David Gibson, director of the Centre on Religion and Culture at Fordham University in New York, told Reuters. "This whole thing was carefully coordinated with conservative Catholic media and carefully timed." The strategy was to damage Francis’s legacy before he either dies or resigns, perhaps due to ill health, and to ensure a conservative successor. "It's the start of the campaign for the next conclave," said Mr Gibson, referring to the secret election held in the Sistine Chapel to choose a new pope. Archbishop Carlo Maria Vigano has gone into hiding since making the allegations against Pope Francis Credit: Pool/Reuters “Behind these attacks there are dark forces,” said Tommaso Valentinetti, 66, an Italian archbishop. The pope’s enemies were “throwing mud” to try to discredit him, he said. The allegations against Pope Francis were first aired in the middle of his trip to Ireland, where he apologised for the Church’s decades of complicity and cover-up in the sexual abuse of children by Catholic clergy. Archbishop Vigano claims that he told Pope Francis of the allegations about Cardinal McCarrick, whom he described as “a serial predator”, back in 2013. He said that rather than punish McCarrick, the Argentinian pontiff had lifted sanctions imposed on him by his predecessor, Pope Benedict XVI. It was only last month that Francis removed McCarrick as a cardinal, ordering him to live a lifetime of penance and prayer, after Church officials in the US found that allegations that he sexually abused a 16-year-old boy were credible. The Pope has not addressed the allegations directly but told journalists on board the papal plane returning from Ireland to Rome to "read the communique attentively and make your own judgement.” In his weekly address in St Peter’s Square on Wednesday, Pope Francis spoke about the sins committed by the Church in Ireland but did not mention the accusations levelled against him by Archbishop Vigano. The de facto leader of the conservatives who are deeply unhappy with Francis’s five-year papacy is Cardinal Raymond Burke, an American. Pope Francis poses with native Mexican people during his weekly audience in St. Peter's Square on August 29, 2018 in the Vatican. Credit: Giulio Origlia/Getty A traditionalist, he has accused the Pope of causing confusion with his remarks about homosexuality and giving Communion to divorcees who remarry in civil ceremonies. Cardinal Burke said on Wednesday that the allegations levelled against the Pope by Archbishop Vigano were “very serious” and had left him “speechless”. “I believe we now need a full response from the Pope and the Vatican,” he told La Repubblica newspaper. Calling for the pope to resign was “legitimate” if it was proved that he had made “grave errors” but the matter needed to be properly investigated, Cardinal Burke said. “I have nothing personal against the pope. I’m simply trying to defend the true faith and the clear presentation of the faith.”

British Thai cave rescue hero sends legal letter to Elon Musk threatening to sue over paedo accusation
The British caving expert who coordinated the rescue of 12 Thai children trapped underground has informed Elon Musk he is preparing to sue him, after the Tesla founder labelled him a “paedo” on Twitter. Vernon Unsworth, 63, enraged the billionaire when he rejected his offer of sending a submarine to assist the rescue, pointing out that it was not a workable solution, and deriding it as a "PR stunt". He said Mr Musk could "stick his submarine where it hurts." Mr Musk hit back, calling Mr Unsworth a “paedo guy”, in a now-deleted tweet. He then issued an apology, and said he had tweeted “in anger”. Elon Musk, founder of Tesla But on Tuesday he reignited the controversy by mocking Mr Unsworth for not following up on his threat to take legal action. On Wednesday it emerged that Mr Unsworth’s lawyers had in fact sent Mr Musk a letter on August 6, informing him of their intention to sue for the “false and defamatory statements.” “You published through three different tweets to your twenty-two million followers that Mr Unsworth engages in the sexual exploitation of Thai children, and you did so at a time when he was working to save the lives of twelve Thai children,” wrote L. Lin Wood, an Atlanta-based defamation expert, in a letter obtained by BuzzFeed. “You did so without any basis. According to a subsequent Twitter post, you did so out of anger.” A Tesla representative did not respond to The Telegraph’s request for comment. Mr Unsworth told Sky News on Wednesday: “It's all being dealt with, that's all I can say."
